General Terms & Conditions

  1. FR8 will arrange for Loads from the Load Providers who approaches FR8, if it is suitable for me/us and for the said purposes the following terms and conditions are agreed upon.
  2. FR8 will act as a goods transport agent(GTA) on behalf of me/us. I/We hereby authorize FR8 to negotiate rates, submit invoice & collect advances / balances from the Load Providers on my/our behalf for the various trips engaged through FR8.
  3. FR8 agrees to act as a del-credere agent by paying the advances / balances at the time which is in practice and then collect the advances / balances from the Load Providers with interest if any.
  4. FR8 reserves the right to brand the trucks using FR8 logo.
  5. I/We are obliged to operate the trucks in good & roadworthy condition, with valid registration and other papers like permits, pollution certificates, FC etc, and will indemnify FR8 for any accident, losses, etc... which may arise out of a violation of above.
  6. Transshipment: If there is any major breakdown and if the truck takes more than a day to recover, transshipment of the goods will be done to other truck by FR8. Transshipment loading & unloading charges and differential market pricing will be borne by me/us.
  7. I/We shall ensure authorized driver/s carrying valid driving license is present during transit.
  8. I/We shall ensure the fitness of vehicle considering all safety measure as guided by RTO along with Insurance.
  9. I/We shall be fully responsible for the safety and proper condition of the goods from the time of loading till the point of delivery. All risks during transportation including theft cases are the responsibility of me/us.
  10. In case of theft / accident of the vehicle, I/We will inform FR8 within 2 hours. I/We are liable to submit the following documents to FR8
    1. F.I.R.,
    2. INSURANCE SURVEY REPORT
    3. PHOTOGRAPHS of the incident
  11. All the above documents will be submitted by me/us to FR8 within 3 days from the date of incident and preliminary information within 24 hours of the accident. If documents are not submitted, I/We will be responsible and liable for payment of such loss or damage. If I/We comply with the above points then a deduction of Rs. 15,000 against insurance incidental charges will be levied.
  12. I/We agree to indemnify, defend and hold harmless FR8 from and against all claims, liabilities, losses, costs or damages arising out of
    1. My/our breach of its obligations hereunder, and/or
    2. My/our acts of omission and any charges by its employees, agents etc.
  13. I/We does not have any rights over the goods in lieu of payments/disagreement with FR8. Any holding of goods is considered theft and FIR can be filed against me/us. I/We are liable to pay demurrage charges of Rs 10,000 per day in addition to all losses to FR8 including material loss and business loss.
  14. Dispute Resolution: All disputes arising from or in connection with this terms & conditions shall be settled under arbitration by the sole arbitrator appointed by FR8. The award of the said arbitrator shall be final and binding on both me/us and FR8. The parties herein shall bear the arbitration charges equally and the arbitrator shall be empowered to pass any interim order any time during such arbitration. The arbitration proceeding shall be in the English language and conducted as per the provision of the Arbitration and Conciliation Act. The venue of arbitration shall be at Chennai.
  15. Jurisdiction: Both the parties mutually agree that this terms & conditions shall be governed by and interpreted in accordance with the laws of India and any dispute in regard to any matter arising out of this terms & conditions, shall have jurisdiction Chennai, irrespective of whether any other court has similar.

Halting Charges

FR8 will pay halting charges for trucks waiting for loading, waiting for unloading as mentioned in the POD based on the below rates, this will be added in the balance payment. It is mandatory to get the date mentioned in POD. Hiring charges applicable in loading, unloading and halting charges.

For example if a 32FT MXL Truck is halted in unloading from 24th December to 2nd January and same is written in POD the Halting charges will be as below

Reimbursement Charges:

FR8 will pay Loading and Unloading charges mentioned by the authorized Shipper / Load provider or their representative in the POD. Any charges or expenses like mamul, toll, incidental, etc… will not be paid.


Deduction by Shippers/Load providers

In case of deduction by Shippers / Load providers like shortage and damage, pod late submission fee, late delivery fee or any other charges. Shippers / Load providers will deduct the claim amount against balance payment. FR8 will mediate between Shippers / Load providers and me/us. FR8 will not be liable to pay me/us the amount deducted by Shippers / Load providers.


Hiring Charges:

Hiring charges will be based advance taken by you and prevailing scheme. Hiring charges will be dispalyed in the app when trip is confirmed and will be deducted during balance payment
